Welcome to Links.fans. These Terms and Conditions are entered into by and between you and Takeoff Newco, Inc. (“Links.fans”, “Links”, "Company", "we", "us", or "our").

These Terms govern your access to and use of:

  • Any subdomains
  • Any mobile applications, including the Links.fans iOS application
  • Any related dashboards, APIs, features, or services

(collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Changes to the Terms

We may revise these Terms at any time. Changes take effect immediately when posted. Continued use of the Platform constitutes acceptance of the updated Terms.

3. Changes to the Platform

We may modify, suspend, or discontinue any part of the Platform at any time without notice. We are not liable if any part of the Platform becomes unavailable.

4. Accessing the Platform and Account Security

To access certain features, you may be required to create an account.

By creating an account, you confirm that:

  • You are at least 18 years old
  • You have the legal capacity to enter these Terms
  • If acting for a business, you are authorized to bind that entity

Account rules

  • Creating or operating multiple accounts may result in suspension or termination

5. User Content

“User Content” includes all links, URLs, redirects, text, images, videos, embeds, metadata, tracking parameters, and any other content you submit to the Platform.

By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, use, display, distribute, modify, and adapt such content for Platform operation, promotion, analytics, and improvement.

You represent and warrant that:

  • You own or have rights to all User Content
  • Your User Content complies with these Terms and all applicable laws

You are solely responsible for your User Content.

6. Content Standards

User Content must not:

  • Be illegal, deceptive, misleading, or fraudulent
  • Promote scams, phishing, malware, or impersonation
  • Infringe intellectual property or privacy rights
  • Contain hate speech, harassment, or violence
  • Misrepresent affiliations or endorsements
  • Redirect to unsafe, malicious, or prohibited websites

We reserve the right to remove or restrict content at our discretion.

7. Company Intellectual Property

The Platform, including its software, design, branding, and functionality, is owned by the Company or its licensors and is protected by applicable laws.

You may not:

  • Imply endorsement or partnership

All analytics, performance data, and aggregated insights generated by the Platform are owned by the Company.

10. Monitoring, Enforcement, and Termination

  • Remove or restrict User Content
  • Suspend or terminate accounts
  • Disclose information if legally required
  • Cooperate with law enforcement

Account termination applies across all platforms, including the website and mobile applications.

11. Fees and Payments

Links.fans may offer free and paid plans.

Web purchases

Payments made through the website may be processed by third-party payment providers acting as Merchant of Record.

iOS In-App Purchases

If you purchase a subscription through the iOS application, payment is processed by Apple via In-App Purchases and is subject to Apple’s terms.

  • We do not control Apple’s billing or refund process
  • Refund requests for iOS purchases must be made directly to Apple
  • Subscription management is handled through your Apple ID settings

Pricing may change with prior notice. Subscriptions renew automatically unless canceled.

12. Reliance on Information

The Platform is provided for general purposes only. We do not guarantee accuracy, availability, or results. Use of the Platform is at your own risk.

13. Third-Party Links

The Platform hosts links created by users. We do not control or endorse third-party websites and are not responsible for their content or practices.

Access third-party links at your own risk.

14. Confidentiality

Any non-public information shared with you by the Company must be kept confidential and used solely for its intended purpose.

15. Linking and Social Features

You may link to your Links.fans page provided it does not imply endorsement or partnership.

We may disable linking or embedding features at any time.

16. Feedback

Any feedback you provide may be used by us without compensation or obligation.

17. Push Notifications

If you enable push notifications on the mobile application, you consent to receiving service-related and transactional notifications. You can disable notifications at any time in your device settings.

18. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”.

WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

19. Limitation of Liability

To the fullest extent permitted by law, the total liability of the Company shall not exceed the greater of:

  • $100, or
  • The amount you paid to the Company in the 12 months preceding the claim

20. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms

21. Apple iOS Application Terms

If you access the Platform via the iOS application:

  • These Terms are between you and the Company, not Apple
  • Apple is not responsible for the Platform or its content
  • Apple has no obligation to provide support or maintenance
  • In case of warranty failure, Apple may refund the purchase price, if any
  • Apple is not responsible for legal claims related to the Platform
  • You represent that you are not located in a restricted or embargoed country
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

22. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA.

23. Limitation on Claims

Any claim must be brought within one (1) year of accrual.

24. Waiver and Severability

If any provision is unenforceable, the remaining provisions remain in full force.

25. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and the Company regarding the Platform.
